Immigration, Refugees and Citizenship Canada (IRCC) has introduced important modifications to the Start-Up Visa (SUV) program, specifically pertaining to the SUV work permit. These changes are in response to the significant demand for the program and the existing backlog of applications, which has resulted in prolonged processing times for permanent residence under the SUV program. Previously, the SUV work permit was issued for a one-year duration, requiring annual renewals. However, as of October 3, 2024, the SUV work permit has undergone notable amendments, which aim to alleviate the administrative and financial burden on eligible entrepreneurs.
IMPORTANT Changes
The proposal for a 3-year work permit was proposed in the Immigration Plan Report and Annual Report for the period 2024–2026 on February 11, 2023. However, this issue has just appeared in the plan and has not been officially determined by IRCC. Finally, opinions from immigrant entrepreneur community has been heard, the new SUV work permit will now be issued for a period of up to three years, replacing the previous one-year term, effective October 3, 2024. This extension aligns with the current processing times for permanent residence applications under the SUV program and provides greater stability for applicants during the interim period.
Eligibility Criteria
It is important to note that the extended work permit will only be available to essential members of the entrepreneurial team. These members must be explicitly identified as essential by the designated entity supporting their Start-Up Visa application. This ensures that only those individuals who are integral to the success of the start-up are granted the benefit of this facilitation measure.
NEW: Introduction of an Open Work Permit
An additional significant development is the introduction of an open work permit under this revised policy. Previously, work permits were employer-specific, limiting applicants to work solely for their start-up. The new open work permit enables applicants to engage in employment outside of their start-up. This measure is intended to provide entrepreneurs with the flexibility to secure supplementary income while simultaneously working on the growth and development of their start-up businesses. This change is particularly beneficial for those entrepreneurs who need to support their families during the early stages of establishing a business in Canada.
Implications for Pending Applications
Entrepreneurs who have submitted a work permit application prior to October 3, 2024, under the former one-year, employer-specific permit system, may choose to withdraw their pending application and apply for the new open work permit. It is crucial to note that withdrawing the work permit application will not affect the processing of the associated permanent residence application. Applicants who choose to reapply will be subject to the terms and conditions of the new three-year open work permit.
